TERMS OF SERVICE

The following terms and conditions are regarding the website of thegro.ai and the product Gro. To use the website and the product, you need to agree to all the statements below, with no objections or modifications to the terms and conditions or regarding any of the operating rules and policies.

Please read this agreement carefully before you access or proceed to use the website and/or the product Gro. If you do not agree with all the terms and conditions, and the policies of Gro, you may not access or use the website and the product.

SUBSCRIPTIONS

The product Gro is billed on a subscription basis. The 14-day free trial applies only to the first subscription for your user account. If you start a second subscription under your user account, the charges for this account will begin on the date the account is activated.

Adding a new seat or removing a seat under an existing subscription will result in a prorated amount being added to your upcoming invoice, and charged on your next billing date, with an amount proportional to the date when the seat was added or removed.

Once you choose your subscription, the amount due will be collected immediately at the time you subscribe. Unless canceled or terminated, the subscription will be automatically renewed for subsequent periods of the same duration as chosen initially. Depending on the subscription period you have chosen, the subsequently due amounts will be collected periodically, each time at the beginning of a new subscription period, on the same day of the month as the initial amount was collected, for as long as the subscription is not canceled or terminated. If you cancel or terminate the subscription without deleting your account, you may resume the subscription under the same conditions, while retaining the data stored

The subscription is monthly and the payment is collected at the time of subscribing and after the first month on the same date every following month. After being renewed, the subscription will continue under the same conditions as the previous month.

The payment method needs to be valid, otherwise the subscription will be terminated. The customer should provide accurate and complete billing information. Once provided with the billing information, GroundAI (Gro) is authorized to and will automatically collect the fee for the subscription (every month). The date of fee collection cannot be changed.

The subscription will last until it’s terminated by the customer or GroundAI. It can be terminated at every given moment and can be renewed immediately after.

SUBSCRIPTION FEE CHANGES

GroundAI keeps its right to change the amount of the fee at any time. The users will be informed in advance and will be given the choice to terminate their subscription or continue using the product with the new subscription price. However, if a discount on your subscription plan expires there will be no reminder or warning sent from GroundAI.

REFUNDS

Unless required by law, the subscription fees are nonrefundable.

ACCOUNTS

When creating an account, the user needs to provide accurate and complete data. Failing to do so is in breach of the Terms and Conditions stated here.

Only personal accounts can be connected to Gro. Each Gro account is valid for only one LinkedIn account.

Gro is not responsible for safeguarding passwords. The user must not share their password with third parties. If they do so, the user is responsible for any further damage or loss. In case of a breach of security or unauthorized use of the customer’s account, the user must immediately inform the team of Gro.

The users agree not to hack other accounts or damage GroundAI’s property and Gro as a product.

LINKEDIN

Gro is not authorized as an official feature of LinkedIn. GroundAI does not take responsibility for the practices and policies of LinkedIn.

GroundAI is not responsible for the personal account of the user or what purposes the product is used for. GroundAI is not responsible or liable, in case of a banning of the user’s account due to the activities executed by the user.

EMAIL FUNCTIONALITY AND COMMUNICATIONS

Gro may allow users to connect email accounts and to send, receive, store, display, and manage emails as part of outreach, communication, automation, or analytics features (“Email Services”).

By enabling Email Services, the user acknowledges and agrees that:

• The user is solely responsible for the content, recipients, timing, and purpose of all emails sent or received through Gro;

• The user is responsible for ensuring that use of Email Services complies with all applicable laws and regulations, including data protection, electronic communications, and anti-spam laws, and for obtaining any necessary consents or ensuring a valid legal basis to contact recipients;

• The user acts as the data controller (or organisation in control under the PDPA) for any personal data contained in emails processed through Gro, and GroundAI acts as a data processor/data intermediary processing such data only on the user’s instructions for the purpose of providing the Email Services.

Email Services may rely on third-party email infrastructure or delivery providers. GroundAI does not control the independent terms, policies, filtering decisions, or deliverability outcomes of the user’s email provider, and is not responsible or liable for any restrictions, blocking, suspension, or other actions taken by such providers arising from the user’s email activities.

GroundAI reserves the right to suspend or restrict access to Email Services where there is reasonable evidence of unlawful use, abuse, or material risk to Gro, third parties, or service deliverability.

DISCLAIMER

The use of Gro is solely a risk taken by the user. Gro is the safest tool and can be used from all parts of the world at any time. However, GroundAI does not take responsibility for the product being interrupted or unavailable at times. GroundAI will inform its users in case of maintenance of the website and/or the product unless it is (being) an emergency.

GOVERNING LAW

These Terms and Conditions are governed and construed in accordance with the Singapore law system.

CHANGES

GroundAI reserves the right to modify and/or replace the Terms and Conditions at any given moment. GroundAI will provide details to its users about any changes in the terms and policies of Gro. Once the changes become functional, the users must agree with the changes. If not, the users must discontinue to use the product Gro.
